Summaries of Appellate Opinions in Georgia
Opinions by the Georgia Court of Appeals and the Georgia Supreme Court are generally released monthly, although the release dates vary. In both courts, opinions are released as “slip” opinions, and are subject to motions for reconsideration, which must be filed within 10 days, and editorial review by the Official Reporter, so the slip opinions cannot be considered final until this process is complete.
Court of Appeals opinions are further subject to the right to apply to the Supreme Court for Writ of Certiorari, notice of which must be filed within 10 days of the Court of Appeals decision if no Motion for Reconsideration is filed or within 10 days of denial of a Motion for Reconsideration, after which the Supreme Court decides whether or not to grant the application. If a Certiorari application is granted, it will be many months before a decision is released.
Once the appeal process is completed, a “final” opinion will be “remitted” to the lower court, and thus the date of remittitur is the “final” date of any opinion. We publish updates once a decision has been remitted to the lower court. We want you to have case authority you can use, confidently, rather than information on cases that might not hold up.
